HOURS OF WORK : 9:00 am - 5:30 pm (7 1/2 hours/day)

SUMMARY :

Under the direction of the Assistant Deputy Chief, Strategic Planning and Deputy Chief of Procurement, Strategic Planning and Rolling Stock, this position is accountable for overseeing a specialized Projects Unit that provides all-agency support to MTA Procurement in the negotiation of procurements of major capital projects, such Subway cars, Passenger Railcars, All agency Fuel, Paratransit broker and Primary contracts. Support includes proposal review and analysis, risk assessment, negotiations of price, contractual terms and conditions and budget forecasting. This position is required to coordinate with outside consultants on strategy, legals matters and executive presentations. This position must be able to complete complex financial analysis and present findings to the Chief Financial Officer, Chief Procurement Officer, and Deputy Chiefs.

The role will also provide procurement support on contracts of materials, goods, and services (both capital and operating); developing and implementing cost/price policies and procedures to facilitate procurement operations; administering the implementation and coordination of these policies and their incorporation into the overall planning of the procurement activities. This position will interface with end-user department and procurement department senior staff and executives to provide negotiation strategies for upcoming complex contracts and initiatives. These strategies will be designed and implemented to deliver the best outcome for the MTA which includes supporting the service delivery goals of the operating departments and minimizing operating and capital budget impacts.

RESPONSIBILITIES :

  • Manages, trains, and develops personnel to carry out the functions of the unit effectively and efficiently. The functions include negotiation activity (for rolling stock, technology contracts, inventory and non-inventory materials, and contracts for technical and professional services) for the User departments; negotiations of change order prices; cost/price analyses as well as the administration and promulgation of cost/price policy and procedures. Responsible for working closely with staff to assure that they are maximizing savings for both capital and operating budgets on all procurement activity.

  • Responsible for providing weekly, bi-weekly and monthly reports and project specific presentations/analyses to senior MTA executives regarding various board and non-board procurement activities, negotiation-related initiatives, savings initiatives, etc.

  • Responsible for overall negotiation support in the management and acquisition of goods and services (both capital and operating), mainly large highly visible and scrutinized projects, such as Subway car, Passenger Railcars, Fuel purchase and Paratransit projects, in excesses of $2 billion annually. This includes developing strategies to streamline the negotiation process and minimize lead times where possible.

  • Responsible for oversight of the determination, pursuant to federal and state requirements, that the contract pricing is Fair and Reasonable to the Authority. Responsible for ensuring that staff: a.) follow federal and state requirements for negotiations and negotiation approaches, b.) negotiate with vendors, and c.) demonstrate for staff and other the various tools and techniques required to acquire goods and services at a price Fair and Reasonable to the Authority, such as Prevailing Wage requirements, escalation and indexing strategies, time value of money and net present value, currency exchange rate strategies, etc.

  • Responsible for overseeing a team which analyses, negotiates, and formally recommends a variety of procurement actions which include, but are not limited to, Sole Source, Pilot Project, and Requests for Proposal procurement approaches as well as negotiation-related activities in response to both emergencies and immediate operating needs on behalf of the MTA. In conjunction with Procurement and end-user departments, this role provides proactive administration of acquisition strategies. This is mostly achieved through partnering and dialogue with senior staff in those departments to ensure that agreed upon negotiation strategies support the user departments’ goals as well as those of the MTA at large.

  • Responsible for assisting in the development and implementing cost/price policies and procedures and ensuring staff compliance to facilitate a lowest cost/best value procurement operation. Reviews, recommends, and develops policy and procedural changes and alternate strategies regarding the cost/price/negotiation function based upon operational performance analysis to increase efficiency and effectiveness of available personnel.

  • Develops, implements, and administers cost/price/negotiation policy and procedures within the framework of applicable Federal Transit Administration (FTA), state, city and MTA regulations, statutes and sound business practices; revision of methods and procedures to incorporate changes based on regulatory and statutory changes: ensure implementation of those revised methods and procedures by staff into the cost/price/negotiation process.

  • Select, develop, and motivate personnel within the department. Provide career development for subordinates. Provide prompt and effective coaching and counseling. Responsible for discipline/termination of employees when necessary. Review performance of staff. Create a professional environment that respects individual differences and enables all employees to develop and contribute to their full potential.

  • Interface with senior operating department staff and MTA executive management as well as senior executives from the MTA’s strategic supplier base to negotiate the best outcomes for complex contracts and initiatives; this also involves addressing contractual and supply chain issues that impact cost and pricing.

  • Responsible for ad hoc special projects in response to both internal and external inquiries.

  • Other duties as assigned.

    KNOWLEDGE, SKILLS, AND ABILITIES

  • Financial analysis experience and being able to anticipate the counterparties’ and/or contractors’ positions when negotiating. Must have a sound business sense and be able to deal effectively with contractors and vendors.

  • Experience in preparing and making presentations to senior staff within and outside of the Authority.

  • Must have a high proficiency in Excel and data base queries to facilitate complex statistical analysis and have an excellent understanding of Word and Power Point or similar applications. Demonstrated proficiency in Microsoft Office Suite or comparable applications, i.e., Word, Excel, PowerPoint, and Outlook.

  • Demonstrated ability to work in a high-profile, high-pressure environment effectively, and to pursue negotiations relentlessly, but professionally, with a data-focused approach.

    EDUCATION AND EXPERIENCE :

    REQUIRED

  • Bachelor’s degree in business administration, Economics, Transportation, Public Policy or a related field or an equivalent combination of education and experience from an accredited college may be considered in lieu of a degree; and

  • Minimum 10 years of related experience

  • Minimum 4 years in a managerial/supervisory position

    PREFERRED

  • Master’s degree in a related field.

  • Familiarity with the MTA’s policies and procedures, particularly with respect to negotiations, request for proposals, sole source, etc.

  • Experience with high dollar and/or complex procurements, extensive knowledge of supply chain dynamics, and/or public-sector procurement environment. Knowledge of public sector procurement management process; public accounting; advanced knowledge of contracting techniques, negotiation strategies.

  • Project management skills

  • Must have knowledge of procurement practice, negotiations, and a basic understanding of legal and contractual procedures.

  • Acquaintance with Public Authorities Law 1209, the MTA All Agency Procurement Guidelines and procurement policy.
