The pay range for this position is $36.49 - $50.07 per hour

The State of New Hampshire, Department of Safety, Office of the Commissioner has a part-time vacancy for Attorney IV, SOC Title 23-1010 LAWYERS-4. This position is part time, which cannot exceed 29.5 hours per work week and does not offer insurance benefits.

SUMMARY:Administers andcoordinates the legal activities of assigned Hearings Examiners and serves as the Chief Hearings Examiner and Litigation Attorney for the Bureau of Hearings.

18 Months or 1.5 Years of additional relevant experience = Associate's degree

36 Months or 3 Years of additional relevant experience = Bachelor's degree

54 Months or 4.5 Years of additional relevant experience = Master's degree

MINIMUM QUALIFICATIONS:

Education:J.D. from an American Bar Association recognized law school.

Experience:Six years' experience in the active practice of law.

License/Certification:Must possess a valid driver's license and/or access to transportation for statewide travel.

SPECIAL REQUIREMENTS:

  1. Must be an active member of the New Hampshire Bar Association and in Good Standing.

  2. Selected candidate will undergo a fingerprint based criminal background check and motor vehicle record check in order to ensure suitability for exposure to confidential information.

RESPONSIBILITIES:

Supervises and coordinates Bureau of Hearings legal staff activities and schedules including ensuring sufficient staff to conduct daily docket of hearings in the most effective and expeditious manner possible.

Conducts or monitors administrative hearings and other hearings, to include ruling on motions to determine relevance of testimony and exhibits, and rendering administrative decisions.

Represents the Director of Motor Vehicles in hearing appeals, including preparing and presenting the State's case before the Superior Courts when a decision made by a Hearings Examiner is appealed.

Monitors legal and administrative compliance with court orders and administrative decisions, and implementing corrective action.

Evaluates bureau operations and makes recommendations for changes to improve efficiency of processes.

Conducts prehearing examinations to define issues, qualify exhibits and explore areas of potential agreements between appellants and the department.

Reviews decisions of courts, other states and the federal government to determine precedent in legal matters.

Drafts and revises legal orders, rules and regulations, including explaining and defending agency goals and objectives.

Makes recommendations on personnel matters including solving personnel problems and implementing corrective measures.

Assumes responsibility of the bureau in the absence of the Administrator of Hearings.
